TERM OF USE

1. ACCEPTANCE OF THESE TERMS

You acknowledge and agree that Bstill (hereafter also “We”/“Bstill”/”us”/Apps/Site ”) owns all legal right, title and interest in and to the Art, and all intellectual property rights therein. By accessing the App or websites at Bstill, you are agreeing to be bound by these terms of service, all applicable laws and regulations, and agree that you are responsible for compliance with any applicable local laws. If you do not agree with any of these terms, you are prohibited from using or accessing this site. The materials contained in this App or websites are protected by applicable copyright and trademark law.  

2.0 ACCOUNT

If you wish to use the Platform, you will need to register an account. By creating an account, you agree to the following:

• to provide accurate, current and complete account information about yourself,
• to maintain and promptly update as necessary your account information,
• to maintain the security of your password and accept all risks of unauthorized
• access to your account and the information you provide to us, and
• to immediately notify us if you discover or otherwise suspect any security

Due to security reason, we strongly discouraged you to change your E-mail address after account created. Such changes will be reviewed on a case-by case basis and subjected to management approval before it can be authorized.  

Bstill reserve the right to imposed a fees on any request for amendment on any account information.

3.0 YOUR ELIGIBILITY

1. you are legally entitled to own the device you are using to access, if you purchase virtual items, you are legally entitled to make such purchases using the payment functionality that Bstill  provide;
2. the information you provide to us is true and accurate and you will update such information when necessary;
3. you will not:

1. copy, licence, sell, trade, alter, create derivative works or otherwise deal with Bstill;
2. use the Bstill for any illegal activities;
3. use any bot, robot, spider or other automatic crawling device (or any manual process) to monitor or copy any of Bstill and their content;
4. use to disseminate any information or materials that are obscene, violent, threatening, libellous, discriminatory or otherwise, in Bstill’s opinion, offensive;
5. use Bstill to disseminate any information or materials that would infringe, or might infringe, any intellectual property rights.

4. PROHIBITION

You agree not to do any of the following:

1. Post, upload, publish, submit or transmit any content that:

• infringes, misappropriates or violates a third party’s patent, copyright, trademark, trade secret, moral rights or other intellectual property rights, or rights of publicity or privacy;
• violates, or encourages any conduct that would violate, any applicable law or regulation or would give rise to civil liability;
• is fraudulent, false, misleading or deceptive;
• is defamatory, obscene, pornographic, vulgar or offensive;
• promotes discrimination, bigotry, racism, hatred, harassment or harm against any individual or group;
• promotes violence that are threatening to any person or entity; or
• promotes illegal or harmful activities;

2. Use, display, mirror or frame the Services, or any individual element within the Services, Bstill’s name, any Bstill trademark, logo or other proprietary information, or the layout and design of any page or form contained on a page, without Bstill ’s e xpress written consent;
3. Access, tamper with, or use non-public areas of the Services, Bstill’s computer systems, or the technical delivery systems of Bstill’s providers;
4. Attempt to probe, scan, or test the vulnerability of any Bstill system or network or breach any security or authentication measures;
5. Avoid, bypass, remove, deactivate, impair, descramble or otherwise circumvent any technological measure implemented by Bstill or any of Bstill’s providers or any other third party (including another user) to protect the Services;
6. Attempt to access or search the Services or download Collective Content from the Services through the use of any engine, software, tool, agent, device or mechanism (including spiders, robots, crawlers, data mining tools or the like) other than the software and/or search agents provided by Bstill or other generally available third party web browsers;
7. Send any unsolicited or unauthorized advertising, promotional materials, email, junk mail, spam, chain letters or other form of solicitation;
8. Use any meta tags or other hidden text or metadata utilizing a Bstill trademark, logo URL or product name without Bstill ’s express written consent;
9. Use the Services for any commercial purpose or the benefit of any third party or in any manner not permitted by these Terms;
10. Forge any TCP/IP packet header or any part of the header information in any email or newsgroup posting, or in any way use the Services to send altered, deceptive or false source-identifying information;
11. Attempt to decipher, decompile, disassemble or reverse engineer any of the software used to provide the Services;
12. Interfere with, or attempt to interfere with, the access of any user, host or network, including, without limitation, sending a virus, overloading, flooding, spamming, or mail-bombing the Services;
13. Collect or store any personally identifiable information from the Services from other users of the Services without their express permission;
14. Impersonate or misrepresent your affiliation with any person or entity;
15. Violate any applicable law or regulation; or
16. Encourage or enable any other individual to do any of the foregoing.

4.0 GRANT OF A LICENCE

In consideration of your agreement to be bound by these Terms, we grant you a single non-exclusive, non-transferable, revocable licence permitting you to access and participate for your personal, non-commercial, entertainment purposes on suitable products and devices.

You may not distribute or make the license available over a network where it could be used by multiple devices at the same time, unless through family sharing or similar functionalities made available by your Mobile Operator;  

You may not transfer, redistribute or sublicense our Apps and, if you sell your device to a third party, you must remove our Apps from your device before doing so;

You may not copy unless is permitted by the Terms of Services, reverse-engineer, disassemble, attempt to derive the source code of, modify or create derivative works of our Apps, any updates or any part thereof (except as and only to the extent that any foregoing restriction is prohibited by applicable law or to the extent as may be permitted by the licensing terms governing use of any open-sourced components included with our Apps)

5.0 LIMITATION OF LIABILITY

In no event shall Bstill be liable for any damages (including, without limitation, damages for loss of data or profit, or due to business interruption) arising out of the use or inability to use the materials on this App, even if Bstill’s authorized representative has been notified orally or in writing of the possibility of such damage. Because some jurisdictions do not allow limitations on implied warranties, or limitations of liability for consequential or incidental damages, these limitations may not apply to you.

6.0 SUBSCRIPTION FEES AND PAYMENTS

We offer paid subscriptions on a monthly or annual basis. You have the ability to cancel or manage your Apps subscription(s) directly through the settings on your mobile device or within the Services. If you choose to terminate your subscription, you will still be able to access the paid Services until the end of the current subscription period for which you have already paid. Following the conclusion of this subscription period, we will not impose any additional charges on you.

By accepting these terms, you confirm that you possess the lawful authority to utilize all payment methods associated with your account and give us permission to charge your credit card or the payment method(s) you have selected for each paid subscription period. Additionally, you acknowledge and agree to be responsible for paying all fees and applicable taxes incurred by you or anyone using your account.

You agree to provide accurate, complete and current financial information. If your financial information changes, we will not be able to process the payment for your subsequent subscription term until you update your financial information, which may result in a loss of access to the Services

We hold the right to modify our subscription fees and packages at any point in time. If there are changes to the subscription fees, we will inform you prior to processing your next payment. In the event that you do not agree to the changes, you have the option to cancel your subscription before the next payment is due.

We accept third party service providers to process your payment as part of the Services. They process your financial information in accordance with their privacy policies, and conduct fraud prevention and anti-money laundering monitoring for legal compliance purposes. In no event will we be responsible for the actions or inactions of third party payment processors, including, but not limited to, system downtime or payment service outages, unless such actions are in breach of these Terms of Services.

By initiating a transaction via the Services, you are providing consent for us to share your Payment Information with third-party service providers in order to complete the Transaction. Additionally, you agree to pay any relevant fees and taxes associated with the Transaction, and permit Bstill to charge your credit card or third-party payment processing account (such as an account with the app store or distribution platform) for verification, pre-authorization, and payment purposes.

You are also responsible for any additional charges imposed by your App Provider, bank, or other financial service provider, as well as any taxes or fees related to your order. A confirmation email will be sent to you once payment for your order has been confirmed. It's important to note that your order is not considered binding on Bstill until it has been accepted and confirmed by us. All payments are final and cannot be refunded or transferred, except as explicitly stated in these Terms.

If you have any concerns or objections about charges incurred, you agree to contact us first and not cancel or dispute any credit card or third-party payment processing charges without first attempting to resolve the issue with Bstill.

Bstill retains the right to decline or cancel your order in certain circumstances, such as if your credit card is declined, if the request or order appears to be fraudulent, or if Bstill  determines it to be appropriate in its sole discretion.

Bstill may, at its sole discretion, verify your identity in connection with your order and request additional information to do so (this information is considered part of Payment Information). In the event that we do not process or cancel your order, we will not charge you or will refund any charges incurred.

7.0 PROMOTION AND DISCOUNT CODES

Every new account, a new subscriptions we will provide a 7 days extra as a gift. From time to time, we may decide to offer promotions and discounts codes. You cannot combine promotions and discounts. We may decide to offer promotions and discounts only to a certain group of users or to potential new users. You agree and understand that you may not qualify for all available promotions and discounts. Unless stated otherwise, promotions and discounts only apply to the initial subscription periods, and any renewals will be charged at the then-current rates for our subscriptions.

8.0 REFUND POLICY

You acknowledge and agree that the Services and gifting codes are non-refundable, and we do not provide any credits for them. If we suspend your account according to the Terms of Service or you voluntarily close your account, you understand that you will not receive any refund or exchange for the Services, except where required by applicable laws. In the event that we terminate the Services, we will either continue to provide the Services until the end of your subscription period, or reimburse you for the unused portion of the Services paid in advance, proportionate to the time remaining in your current subscription period.

9.0 ACCURACY OF THE MATERIAL

The materials appearing on App could include technical, typographical, or photographic errors. Bstill does not warrant that any of the materials on its App are accurate, complete or current. Bstill may make changes to the materials contained on its Appat any time without notice. However, Bstill does not make any commitment to update the materials.

10.0 MODIFICATION

Bstill may revise these terms of service for its website at any time without notice. By using this App you are agreeing to be bound by the then current version of these terms of service.

11.0 DISCLAIMER

The materials on the App are provided on an ‘as is’ basis. Bstill makes no warranties, expressed or implied, and hereby disclaims and negates all other warranties including, without limitation, implied warranties or conditions of merchantability, fitness for a particular purpose, or noninfringement of intellectual property or other violation of rights. Further, Bstill does not warrant or make any representations concerning the accuracy, likely results, or reliability of the use of the materials on its App or otherwise relating to such materials or on any sites linked to this site.

Accessing this App or using the information on this App does not mean that the Bstill offers or offered in any jurisdiction in which such services would be unlawful under relevant laws of such jurisdiction. It is the responsibility of any persons who access the information contained in this website to observe all applicable laws and regulations of such jurisdiction.
